These Terms apply to Titan Cladding Construction services provided in Australia. Please read them carefully before requesting a quote or engaging us for works.

1) Definitions

We / us / our means Titan Cladding Construction (ABN: [insert ABN]), based in Melbourne, VIC.

You / your means the client engaging us (individual or business).

Works means services supplied by us (e.g., cladding, plastering, partitions, ceilings, demolition, site cleaning).

Quote means our written estimate for a stated scope and assumptions.

Variation means a change to scope, materials, access, program, or conditions affecting time/cost.

2) Acceptance of Terms

By requesting a quote, approving a quote, issuing a purchase order, paying a deposit, or otherwise instructing us to proceed, you agree to these Terms.

If your order terms conflict with ours, our Terms apply unless we agree in writing.

3) Quotes, Scope & Assumptions

Quotes are based on the scope described and assumptions known at the time (site access, working hours, existing conditions, drawings/specs, and availability of materials).

Unless stated otherwise, quotes may exclude: permits, engineering, design, asbestos/hazardous materials handling, after-hours access costs, and latent conditions (hidden defects or unforeseen site conditions).

Quote validity is typically limited (e.g., 7–30 days). After that, pricing may change due to suppliers or scheduling.

4) Variations

If the scope changes (including client requests, site conditions, or changed instructions), we may issue a variation. Variations can affect price and completion dates.

Where practical, we’ll seek written approval before proceeding. In urgent situations (e.g., safety or compliance), we may proceed and confirm the variation after.

5) Scheduling, Delays & Site Access

Timeframes are estimates unless expressly guaranteed in writing. Delays can occur due to weather, supply issues, access restrictions, other trades, client decisions, or events outside our control.

You must provide safe access to the site, adequate working space, and reasonable site facilities as required.

6) Safety & Compliance

We follow applicable Australian standards and safety obligations (including relevant OH&S requirements). You must notify us of known hazards (including asbestos or hazardous materials) before works start.

If unsafe conditions exist, we may stop work until the issue is addressed.

7) Payments

Payment terms (deposit/progress/final) will be stated on the invoice or quote. Invoices are payable within the period shown.

If payment is overdue, we may suspend works and/or charge reasonable recovery costs as permitted by law.

Where applicable, title in supplied materials may remain with us until paid in full.

8) Warranties & Australian Consumer Law

Our workmanship warranty (if offered) and any manufacturer warranties apply as described in your quote or documentation.

Nothing in these Terms excludes, restricts, or modifies rights you have under the Australian Consumer Law that cannot be excluded.

To the extent permitted by law, our liability is limited to (at our option) re-supply of services or payment of the cost of having the services supplied again.

9) Liability & Indirect Loss

To the extent permitted by law, we are not liable for indirect or consequential loss (e.g., loss of profit, loss of opportunity, business interruption).

We are not responsible for damage caused by pre-existing site conditions, other trades, or client-supplied materials/instructions.

10) Intellectual Property

Any templates, drawings, documents, or materials we provide remain our property unless agreed otherwise in writing.

11) Privacy

12) Disputes & Governing Law

If a dispute arises, both parties agree to act reasonably and attempt to resolve it promptly (including by discussion/negotiation).

These Terms are governed by the laws of Victoria, Australia, and the parties submit to the jurisdiction of the courts of Victoria.

13) Updates to These Terms

We may update these Terms from time to time. The version published on this page applies to new quotes and new works.
